As part of the terms of granting the patent to the inventor, patents are published into the public domain.
Patent infringement is the unlawful use, selling, or copying of a patented invention. United States patent law protects such inventions. A patent is a type of intellectual property that the inventor could seek protection by filing a patent application.
Patent data provide a uniquely detailed source of information on inventive activity and the multiple dimensions of the inventive process (e.g. geographical location, technical and institutional origin, individuals and networks).
Patents may be searched using the following resources: Patent Public Search. Global Dossier. Patent Application Information Retrieval (PAIR) Public Search Facility. Patent and Trademark Resource Centers (PTRCs) Patent Official Gazette. Common Citation Document (CCD) Search International Patent Offices.
Can I obtain a patent and keep my invention secret? No. Patents are granted by patent offices in exchange for a full disclosure of the invention. In general, the details of the invention are then published and made available to the public at large.
The penalties for patent infringement can be severe, including paying damages to the patent owner, paying the patent owners legal fees, and being prohibited from selling the infringing product. In some cases, the court may even order the destruction of the infringing product.
Copies of patents, patent applications, and many other patent-related filings are available on the USPTO web site. Patent searching can be done directly on the USPTOs web site. Full text and images are available for patents from 1976 to the most recent Tuesday.
