A Note on Works Made for Hire If the photographs were created as works made for hire, the employer or commissioning party is considered the author and owns the copyright to the images rather than the photographer.
Every photographer is different, as will be their backup strategy and how long they hold onto images. Make sure you ask how long theyll keep photos from your session, and also make sure there is language in their service agreement reinforcing that information!
The photographer owns the copyright in any commissioned photographs they take and can use them however they like. However, the individuals who commission the photographs are able to make personal or non-commercial use of the photos if they have paid for them.
Generally speaking, the copyright belongs to the person who created the image in the case of a photograph the person who took it (i.e. the photographer.) There are some exceptions to this for example if the photographer is an employee (for example in a large studio) the copyright belongs to their employer.
As a general rule, for works created after January 1, 1978, copyright protection lasts for the life of the author plus an additional 70 years.
Many photographers, however, do not want to completely relinquish their rights because they may be trying to build or protect their reputation. When creative freelancers and professionals sign a Work for Hire Agreement, they effectively give up all of their rights.
In the United States, the person who creates the photograph owns the copyright from the moment its created. The only exception would be work done for hire, which typically involves actual employment, or a contract that specifically sets that relationship. Hiring me is NOT work for hire.
Image Usage Rights When a wedding photographer (me, again) captures the a photo, they automatically own the copyright over the images they shoot even though the pictures are of you. Most photographers these days include high-resolution versions of the photos, which you are free to print, post on social media, or etc.
