In general, the permissions process involves a simple five-step procedure: Determine if permission is needed. Identify the owner. Identify the rights needed. Contact the owner and negotiate whether payment is required. Get your permission agreement in writing.
There are only four simple components you need to include: The copyright symbol or the word copyright The name of the copyright owner or author of the work. The year the content was published, which can be different from the year of creation. Your statement of the rights youre reserving over the materials.
The exception to this is a rule called fair use. Fair use means you can use copyrighted material without a license only for certain purposes. These include: Commentary. Criticism.
If your use of a copyright-protected work isnt permitted by a licenced database (or something similar) or by one of the exceptions in the Copyright Act, you will need to ask for permission. The first step in seeking permission to use a copyrighted work is to identify the copyright owner.
If (1) fair use or another users right does not permit your use, (2) the work youre using is not in the public domain, and (3) you want to use the work in a way that one of the copyright owners exclusive rights regulates, you will need permission to use the work.
Here is a general format example: From Title of Webpage or Publication, by A.A. Author, year, Site Name (DOI or URL). Copyright [year] by Name, OR In the public domain., OR Creative Commons license such as CC BY-NC. Reprinted with permission.
These elements include any music (even if its just playing in the background), video clips, photos, and so on. First, docHub out to the copyright owners or rightsholders directly and negotiate the appropriate licenses for your use. Then, check the license.
In your request, you should include the following: The specific rights you would like (i.e. to do what with the content) The set amount of time you would like the rights for. Whether you want exclusive or non-exclusive rights (typically non-exclusive) Identify the geographic area where you will use the work.
