Downloading or uploading copyrighted work without authority constitutes an infringement. Willful copyright infringement can result in criminal penalties including imprisonment of up to five years and fines of up to $250,000 per offense. Copyright infringement can also result in civil judgments.
Foods cannot be trademarked because they do not represent a brand. However, food names can be trademarked because they identify a companys food product and represent brands. Product names, including the names of food products, are eligible for trademark protection when used in branding.
Copyright does not protect ideas, concepts, systems, or methods of doing something. You may express your ideas in writing or drawings and claim copyright in your description, but be aware that copyright will not protect the idea itself as revealed in your written or artistic work.
When it comes to food products, it may not be only names and logos that can be trademarked. You may also be able to trademark other distinctive product attributes. For example, if the shape, color, packaging, or other design element is distinctive to your product, you may be able to have it trademarked.
Even if the description of the recipe is sufficiently creative and copyrightable, the copyright will not cover the recipes ingredient list, the underlying process for making the dish, or the resulting dish itself, which are all facts. It will only protect the expression of those facts.
A collection of recipes, as in a cookbook, can be protected. That protection is stronger if the author adds original literary commentary and uses creativity in the selection of recipes. Merely listing ingredients, however, is likely not enough.
The menu or recipe must be original and fixed in a physical medium of expression, such as printed on paper or recorded on a computer, to be deemed copyrightable. Copyright protection cannot be obtained simply by having a concept for a menu or dish.
Similar to ideas, facts and history, there isnt copyright protection in recipes as mere lists of ingredients. This is clearly stated by the U.S. Copyright Office. Most recipes, however, include content beyond the ingredient list.
