Copying includes printing, photocopying and similar methods of mechanical duplication. It is not permissible to reproduce copyrighted materials without the written authorization of the copyright holder unless it qualifies under the copyright laws doctrine of fair use.
An invoice on its own is not a contract in a legal sense, because it does not prove an agreement between two parties. Instead, an invoice is created by a business and sent to a client to request payment for its services and is therefore a one-sided document.
In and of itself, an invoice is not a legally binding agreement. If an invoice on its own was a legally binding document, then vendors could create bogus invoices and then force their clients to pay them. If both sides do not agree to the invoice, then it is not legally binding.
Section 12 of the Copyright Act provides that the Crown owns the copyright in works that are prepared or published by or under the direction or control of the Crown or any government department, subject to any agreement stating otherwise.
A customer could order goods from you and then deny doing it. The fact that you issued an invoice to such a person will have no legal force. Until both parties accept the invoice, it is not legally binding. That is why it is so important to have an order confirmation from the person ordering the goods or services.
What to include in your invoice for contract work. Your name (or company name) and contact details. Your clients name and contact details. Date of invoice. Invoice number. Itemized list and description of services. Date or duration of service. Pricing breakdowns, such as hourly or flat rates. Applicable taxes.
Since invoices are not considered to be legal documents, it shouldnt come as a surprise to read they are not contracts either. Thats because an invoice is a request for payment and does not legally bind the client to pay it. A contract, however, is the legally binding document that can be enforced in court if needed.
By definition, false invoices are accounting documents issued with the intention of deceiving the tax authorities and obtaining illicit benefits.. They can be generated to simulate taxes that never occurred or to inflate the value of a real transaction.
