Bob go ahead hey good morning Tom I guess I speak on behalf of everyone thank you so much for all your advice we really appreciate the show Ill try to be brief here Ive got a apartment building over here thats a hundred years old had a tenant and the upstairs unit putting cigarettes out on the deck and you know throwing the cigarette butts everywhere I gave them a seven day notice to cure back on June 28th back on June 28th and last night I get a call from another tenant that theres a flowerpot on that deck on fire and fortunately the tenant went up and put the fire out the tenant would not come to the door I went up this morning and nailed the notice of seven days to vacate do I need to do do I need to do a three day notice also tom bob in your lease does it say no smoking it does not you next time you may know better right to put no smoking in your linear lease right without question all right so Bob its not like hes violated the lease because your lease did not say no smoking

Heres a brief summary of the law in BC with as it relates to tenants and smoking. If your Lease does not include a no-smoking clause, you are allowed to smoke in your own unit and this includes your balcony. However, tenants do not have unfettered rights to smoke.
Some cues to watch for include the following: The Smell. Cigarette smoke lingers in the air and can also attach itself to upholstery, carpets, curtains, and other items inside an apartment. Ashes and Residue. Stains on Surfaces and Fixtures. Coloring on Walls. Burn Marks. Cigarette Butts.
Tenants can be evicted for smoking in a non-smoking building If a tenancy agreement doesnt allow smoking and tenants smoke in the rental unit, they are bdocHubing the agreement. Tenants may have to pay for smoking-related damage to the unit or the landlord can choose to end the tenancy.
A landlord may end a tenancy if one or more of the following applies: Disturbances and safety concerns. Failure to repair damage. Government orders. Illegal activities. Non-compliance with directors orders. Non-payment of deposits. Occupancy violations. Property damage.
Talk to your landlord or co-op/condo board representatives and other neighbours and seek their support. You are likely not the only person being affected by unwanted smoke. Contact your tenant association, co-op or condominium board to inform them about the issue or to make a formal complaint.
Example addendum term: The Tenant agrees to the Cleaning Schedule as set out in the Cleaning Schedule attached to this Residential Tenancy Agreement and agrees to the deductions from their damage deposit should they fail to clean the unit thoroughly.
Landlords in Ontario have the right to ban smoking in all or part of a building, including indoor units and outdoor patios and balconies. While they cannot change current tenancy agreements, landlords can include a non-smoking clause in new agreements.
