Im Attorney Aiden Durham with 180 Law Co. in Colorado, and today were gonna talk about how to get a registered trademark for a standard character mark, like a business name or a slogan. I talked a lot about some of the prep to go through before you submit the trademark application, like doing a trademark clearance search, making sure you have a good, strong trademark thats worth registering, some of the more procedural aspects of the trademark application in the application process, things like that. This time around, were gonna skip over a lot of that stuff and focus more on the specifics, and specifically, as they relate to doing a trademark application for a standard character mark. Checking the USPTO trademark database for assignment /name change Go to TSDR. Enter the application serial number or registration number. Select the Status button. Scroll down to the Current Owner(s) Information section. Check to see that your owner information was updated correctly.
An assignment is a complete transfer of rights, where the original owner relinquishes all rights and interests in the trademark to the new owner.
To assign ownership to another party, there needs to be a contract agreement between the current owner (the assignor) and the proposed owner (the assignee). This agreement will need to be signed by an authorised person.
A written request to record or register a transfer must include the name and the postal address of the transferee and the requisite fee. As of 2023, the requisite fee is $100. The applicant or any person authorized by the applicant (e.g., an agent) may make such a request.
To change the owner of a federal trademark registration or application, a trademark assignment should be signed and recorded with the USPTO. A trademark assignment is a document signed by the original owner (assignor) that transfers ownership of the trademark to a new owner (assignee).
