The 1099 correction form is the same as the original form. You must use a regular copy of Form 1099 (either NEC or MISC) and mark the box next to CORRECTED at the top. Send corrected Forms 1099 to the IRS, contractor or vendor, and state agencies (if applicable).
Youll address the discrepancy on your tax return on line 21, or on a Schedule C. You will need to show the client reported an erroneous amount on your 1099 and attach a statement to explain the difference. In your statement, include the amount reported, the difference, and the correct amount.
Copy C is for your records. Copy 1 is for you to file with your state when required.
You can e-file any Form 1099 for tax year 2022 and later with the Information Returns Intake System (IRIS). The system also lets you file corrections and request automatic extensions for Forms 1099. 10 or more returns: E-filing is required. For system availability, check IRIS status.
Penalties for Correcting a 1099 Form All businesses must submit a corrected 1099 form if they make an error on their original form. The IRS will issue some penalty depending on the type of error and whether it was intentional. A business generally must pay $100 per incident.
The corrected form should be filed in the same manner the original was filed. If the original was e-filed, the correction should be e-filed. If the recipient of the original form has different information in their records, they will likely contact you for an explanation and/or correction of the Form 1099.
Copy 1 is sent to your state tax department. Copy B is sent to the recipient. Copy 2 is also sent to the recipient. Copy C is kept for your own business tax records.
Yes, the red form is required for Copy A of the 1099. Copy A is printed in red because it prevents duplication.
