A quitclaim deed transfers the title of a property from one person to another, with little to no buyer protection. The grantor, the person giving away the property, gives their current deed to the grantee, the person receiving the property.
A person can file a quitclaim deed by (1) entering the relevant information on a quitclaim deed form, (2) signing the deed with two witnesses and a notary, and (3) recording the deed at the county comptrollers office.
Under Missouri Revised Statutes Section 442.130, the grantor must sign the deed in the presence of a notary public.
The grantee receives the property. Write the grantees legal name as well as how the title is taken Jim J. Doe, a single man, for example. Only the grantor signs the quitclaim deed, signing before a notary public.
Under Arizona law, a quitclaim deed must contain a legal description of the property, meet certain signing and acknowledgment requirements, and use the correct terminology. You must record the deed with the County Recorders Office and pay the appropriate fees but you will not need to pay a transfer tax.
Contrary to normal expectations, the Deed DOES NOT have to be recorded to be effective or to show delivery, and because of that, the Deed DOES NOT have to be signed in front of a Notary Public. However, if you plan to record it, then it does have to be docHubd as that is a County Recorder requirement.
