You can use a Prenuptial Agreement Template online but each party would still need to get an Independent Legal Advice (ILA) Certificate from a Lawyer. Therefore, using a template to save costs would defeat the purpose if you still need a lawyer to issue a certificate of Independent legal advice.
When executed properly, a Prenuptial Agreement is a legally binding contract. However, a court may rule that the contract (or a part of it) is void if one party can prove that the agreement is unfair or illegal. For instance, a Prenuptial Agreement may be void or voidable if: There was a failure to disclose all assets.
Prenuptial agreements are enforceable in Canada. Courts in Ontario and other common law provinces of Canada previously considered marriage contracts to be contrary to public policy and unenforceable, but the 1978 Family Law Reform Act (now continued in the Family Law Act) specifically authorizes marriage contracts.
The agreement may be thrown out if it is proven that one party did not disclose assets or undervalued their assets. The contract becomes unenforceable if the court determines that one of the parties was dishonest or is guilty of misrepresentation.
2) A prenup can be invalidated or revoked: Yes, both parties sign prenup only when they feel that the agreement is right and fair. However, if at any stage, both parties feel that the rights included in the prenup arent fair and they are a victim of something wrong, they can get the prenup invalidated legally.
The agreement must not be signed under duress or signed by someone without the mental capacity to understand the terms of the agreement when signing it. For instance, if the prenup was signed when one party was under the influence of drugs, it could be a reason to invalidate it.
Prenups are enforceable in Canada as long as they are valid. Marriage contracts may not, however, deal with the right to custody of or access to the spouses children.
Bottom line is no prenup is ever 100 percent guaranteed. Admittedly prenups are not perfect and dont account for the passage of time, adding they are invalidated by the court a little less than 50 percent of the time.
