A FAR Part 91 MEL consists of the MMEL for a particular type aircraft, the MMELs preamble, the procedures document, and a LOA. The FAA considers the MEL as an SC. As such, the MEL permits operation of the aircraft under specified conditions with certain equipment inoperative.
The Minimum Equipment List is a more restrictive version of the MMEL. The MEL takes into account the operators (e.g., airlines) operational criteria and must be approved by the operators National Aviation Authority (NAA).
You will mostly find MELs in aircraft operating under Part 121, 125 and 135. The military also uses MELs.
2.1 Overview. The MMEL is developed by the airworthiness authorities of the aircraft manufacturing country, to guide the aircraft users and airlines to compile the programmatic document of MEL specifically.
Part 121 and Part 125 both allow for carrying people, however, whereas Part 121 permits carriers to operate scheduled flights, Part 125 only makes provisions for carrying passengers without receiving compensation in return.
The MEL is the specific inoperative equipment document for a particular make and model aircraft by serial and registration numbers; e.g., BE-200, N12345. Part 125 was issued to establish a uniform set of certification and operational rules for large airplanes having a seating capacity of 20 or more passengers or a maximum payload capacity of 6,000 pounds or more, when used for private carriage.
