Resolving trade disputes is one of the main tasks of the World Trade Organization, or WTO. Since its inception in 1995, some 595 disputes have tested the WTOs Understanding on Rules and Procedures Governing the Settlement of Disputes, also known as the DSU. Over 350 rulings have been made by ad hoc panels appointed specifically to hear each case. If neither party appeals, the Dispute Settlement Body, which includes all WTO members, is obliged to adopt the panel report, unless there is consensus against its adoption. An appeal of a panels ruling is heard by three members called a division of the WTOs Appellate Body, a standing body of seven trade experts with four-year terms. The division can uphold, modify or reverse the findings of a panel. For 20 years, the Appellate Body and the DSU continued to operate as they did in 1995, even though concerns were raised periodically about the need to modernize and reforms were proposed but never adopted. It is well settled that adopted panel and Appellate Body reports are not binding, except with respect to resolving the particular dispute between the parties.
The DSB has authority to establish dispute settlement panels, refer matters to arbitration, adopt panel, Appellate Body and arbitration reports, maintain surveillance over the implementation of recommendations and rulings contained in such reports, and authorize suspension of concessions in the event of non-compliance
The DSB uses a special decision procedure known as reverse consensus or consensus against that makes it almost certain that the Panel recommendations in a dispute will be accepted.
The Appellate Body can uphold, modify or reverse the legal findings and conclusions of a panel, and Appellate Body Reports are adopted by the Dispute Settlement Body (DSB) unless all members decide not to do so.
A standing Appellate Body shall be established by the DSB. The Appellate Body shall hear appeals from panel cases. It shall be composed of seven persons, three of whom shall serve on any one case. Persons serving on the Appellate Body shall serve in rotation.
Unlike panels, the Appellate Body is a permanent body of seven members entrusted with the task of reviewing the legal aspects of the reports issued by panels. The Appellate Body is thus the second and final stage in the adjudicatory part of the dispute settlement system.
A settlement is the result of an agreement between the parties to the disputes to compromise and/or end the litigation or dispute if no proceedings have begun. It arises from an offer by one party that is accepted by the other or others.
Currently, the Appellate Body is unable to review appeals given its ongoing vacancies. Each Member of the Appellate Body is required to be a person of recognized authority, with demonstrated expertise in law, international trade and the subject-matter of the covered agreements generally.
