You can assign your lease if you decide to leave your rental unit permanently during the course of the lease. You transfer your lease to someone else and have no further responsibilities as a tenant under the lease.
Once the lease has been transferred, a new annual lease is agreed upon with the new lessee, and the rent is reviewed in compliance with current regulations. The new lessee must pay a non-refundable administrative fee of $420.81 (including GST and QST) to cover the cost of issuing the lease.
To rent or sublet a house or an apartment that is declared as family residence, one spouse must obtain the written consent of the other spouse. If consent has not been obtained, the affected spouse can apply for the annulment of the rental or sublet.
In order to transfer your lease, you must find a reliable tenant, send a Notice to assign document to your landlord with the prospective tenants information. Next, you wait 15 days for the landlords reply after which you will sign the Assignment of lease agreement document with the new tenant.

The subtenant must give a notice of one month in order to terminate the sublease. The subtenant is also required to give reasons for leaving the premises. A sublease can be terminated early if the subtenant is willing to pay the rent until the end of the month and an amount in addition to this.
For leases of 12 months or longer, the notice must be given at least 3 months and not more than 6 months before the end of the lease. For the lease of a room the notice is of not less than ten days nor more than twenty days (article 1942 Civil Code of Quebec).
One year is most typical. If you break the lease, youre breaking a contract, and the landlord can hold you responsible for paying the rent until the end of your lease term. For example, if you pay $1,800 a month and want to break your lease for the last four months, you could end up on the hook for $7,200.
