To change (modify) a Parenting Plan and Parental Responsibility, a parent must list how the childs circumstances have substantially changed and/or how changes in a parents circumstance have substantially impacted the child, and describe how making a change will be good for the child.
You can ask a judge to change a custody, visitation, child support, or medical support order. You must file a petition to modify in the court that has jurisdiction over your child.
Thus, the requesting party must show that a change is justified. Common substantial changes in circumstances may include: a loss or gain of employment, a sudden change in either partys finances, a relocation of the parties or children, a death, a change in the childs wishes, etc.
If you already have a court order for custody or visitation, you can request the court to change custody or visitation. To do this you may: (1) obtain the services of an attorney to handle your case; or (2) file the case yourself by using the Domestic Relations forms.
Once every three years, either parent has the right to ask the office of Child Support Enforcement to review the child support order for possible modification. If you request a review and modification, you should put your request in writing and keep a copy for yourself as proof that you made the request.
How Do I Request Modification? Making a request only requires you to submit one form: Form FL-300, the Request For Order. Once filed with a court, the process will begin in earnest. You may also file Form FL-311, Child Custody, and Visitation, though this is optional.
Maryland is one of many states that allow a child to weigh in with their preferences at 16 years of age. It also allows children 16 years and older to petition the court for a change of custody if theyre not happy with the arrangement ordered in the initial decree.
The Court of Appeals of Maryland has explained that a change in circumstances is material only when it affects the welfare of the child. A parents relocation in and of itself may not constitute a material change in circumstance unless one of the parties shows that it has materially affected the welfare of the child.
