You can ask a judge to change a custody, visitation, child support, or medical support order. You must file a petition to modify in the court that has jurisdiction over your child.
Section 3109.04 of the Ohio Revised Code provides the Court with a variety of options when handling child custody and parenting time issues. However, once a Shared Parenting Decree or other Order establishing parenting time is in effect, it can only be modified by filing a Motion with the Court.
Under Texas law, either parent may file a petition seeking child custody modification anytime. The petition must be filed in the court that granted the divorce, unless the child has moved.
What must we do? In Ohio, if you previously went through a court proceeding where custody and parenting time was established, you may modify your previous agreement any time you wish. If you and the other parent agree, you can simply file a motion asking the court to modify the previous custody order.
Steps to Change a Custody Order Get the current custody (parental responsibilities) order. Fill out your custody modification forms. File your forms with your local countys court. Tell the other party about your petition and the upcoming court date through legal service. Go to your hearing.
Youre always welcome to change the way you make your child support payments, but the court-ordered amount can change only through a court order. Even if you are having trouble making your full payment, it is important to pay as much as you can toward your obligation every month.
If a parent wants to change an existing court order and the other parent wont agree to the change, he or she must file a motion (a written request) asking the court that issued the order to modify it.
