This video explains the sublease consent form for sublease agreements. It's important to differentiate between a sublease and an assignment. A sublease is an agreement between the tenant (current leaseholder) and a subtenant, which can involve part or all of the premises. In a sublease, the tenant retains privity of contract with the landlord but only transfers privity of estate to the subtenant, creating two separate contractual relationships. The subtenant does not have a direct relationship with the landlord. If issues arise with the premises, the subtenant must communicate with the tenant, who then informs the landlord. Unless a lease expressly prohibits subleasing, tenants may generally do so, but obtaining consent is advisable to prevent misunderstandings.
