Under the California Family Rights Act, employers with five or more employees must provide five days of bereavement leave. Employees are eligible if they've worked for at least 30 days before the leave. The definition of "family member" is broad, encompassing domestic partners and extended family members. The leave can be taken intermittently but must be completed within three months following the family member's death. While the leave can be unpaid, employers with a paid bereavement leave policy will need to adhere to their existing terms.
