Mortgage Assignment Basics Mortgages are assigned using a document called an assignment of mortgage. This legally transfers the original lenders interest in the loan to the new company. After doing this, the original lender will no longer receive the payments of principal and interest.
An assignment is the document that is the legal record of this transfer from one mortgagee to another. In a typical transaction, when the mortgagee sells the debt to another bank, an assignment is recorded, and the promissory note is endorsed (signed over) to the new bank.
The most common example of an Assignment of Mortgage is when a mortgage lender transfers/sells the mortgage to another lender. This can be done more than once until the balance is paid. The lender does not have to inform the borrower that the mortgage is being assigned to another party.
The release assignment must be recorded at the local land office in order to be valid. It contains a legal description of the property, the borrowers name, the title companys contact info and the date the release takes effect. A copy of the release is sent to the borrower and should be kept for future reference.

In most circumstances, a mortgage cant be transferred from one borrower to another. Thats because most lenders and loan types dont allow another borrower to take over payment of an existing mortgage.
An assignment of mortgage is a legal term that refers to the transfer of the security instrument that underlies your mortgage loan aka your home. When a lender sells the mortgage on, an investor effectively buys the note, and the mortgage is assigned to them at this time.
