Under Texas real estate law, the forgery of a deed is considered a state jail felony. Deed forgery may be found in one of the following forms: A document is written or altered in some way under false pretenses, or. An individual makes these alterations or documents with the intention of defrauding another person.
There are two offenses in the Texas Penal Code which can be used in dealing with hot checks: Theft (P.C. 31.03) and Theft of Service (P.C. 31.04). These offenses range from Class C Misdemeanor to Felony of the first degree, depending on the amount of the check.
Penal Code 32.21. FORGERY. (b) A person commits an offense if he forges a writing with intent to defraud or harm another. (c) Except as provided by Subsections (d), (e), and (e-1), an offense under this section is a Class A misdemeanor.
Forgery, as per 32.21 of the Texas Penal Code, occurs when a person forges a writing with intent to defraud or harm another. To forge under this section means to alter, make, complete, execute, or authenticate any writing so that it purports: to be the act of another who did not authorize that act.
Forgery. (C) to possess a writing that is forged within the meaning of Paragraph (A) with intent to utter it in a manner specified in Paragraph (B). (C) symbols of value, right, privilege, or identification.
Forgery under 32.21 is usually a Class A misdemeanor but becomes a state jail felony if the forged document is a check or credit card. The penalties for a state jail felony are 180 days to 2 years in jail and a fine up to $10,000.
Fraudulent Destruction, Removal, or Concealment of Writing, as per 32.47 of the Texas Penal Code, occurs when a person, with intent to defraud or harm another, he destroys, removes, conceals, alters, substitutes, or otherwise impairs the verity, legibility, or availability of a writing, other than a governmental
The crime is a class A misdemeanor which is punishable by up to 1 year in county jail and a fine of up to $4,000.
