Court records are generally open to the public, with several exceptions. Records that have been expunged, shielded, or sealed by court order are not available to the public. In addition, the following records are not open to the public without a court order or a special provision of the law: Adoption.
Yes, there are certain cases where you generally cannot get records expunged. If you received a PBJ, and you were later convicted of a new crime within 3 years of the PBJ, you cannot get the PBJ case expunged. You cannot file for expungement of any records if you currently have criminal proceedings pending against you.
Individuals convicted of a felony are prohibited from possessing firearms in Maryland. But there are ways to potentially regain this right. The only method to restore firearm rights is by obtaining a pardon.
Certain assault and battery convictions may be expunged after 7 years.
The filing fee is $30 for eligible guilty dispositions and is nonrefundable, even if denied. The fee is for each case (not for each charge related within a unit of the case). If you cannot afford the fee, you may request that the court waive the filing fee.
Expunged information will not show up in background checks. You are not legally required to tell employers about an expunged record except in certain circumstances not governed by Maryland law. This brochure is about expunging adult criminal records about you from Maryland state court records only.
Under federal law, the consumer reporting agencies cannot report an arrest over seven years old. However, they may report a conviction no matter how old it is.
Generally, you fill out a Petition for Expungement of Records and file it with the court that heard your case. If it has been less than three years from the time your case was concluded, you will also need to file a General Waiver and Release. A filing fee of $30 may apply. This filing fee is not refundable.
