Once expunged, such records cannot be accessed for general law enforcement or civil use. However, under certain exceptional situations, the expunged records can be searched, retrieved, and used, but this occurs only in exceptional circumstances which normally require a court order or statutory authorization.

If you have successfully gotten a 1203.4 dismissal (expungement), it does NOT mean that the conviction is wiped away, sealed, purged or destroyed! The arrest is still there, charges are still there, but technically the conviction is set aside and dismissed.
Once the court grants an expungement, you can legally answer no if asked about a criminal record UNLESS: You are applying to become a peace officer or run for public office, You are applying to work for the California Lottery Commission, or. You are applying for a state license.
How do I apply? Contact the Public Defender or legal aid. The Public Defender or legal aid in the county where you have convictions will be able to help you start the process. Submit petitions if eligible. In about 2-6 weeks, the Public Defender or legal aid will contact you. Receive decision.
An expunged arrest is removed completely from the public record. Sealing court records generally only applies to crimes committed by juveniles. The arrest and conviction will remain on the persons record but can only be seen by court order. Sealed records should not turn up in a criminal background check.
When your conviction is dismissed, it is not removed from your criminal record held by the California Department of Justice, but the record will show that your conviction was dismissed. Many public employers will likely be able to see your conviction, but will also see that it has been expunged.
You can ask the court to seal certain felony and misdemeanor convictions: If you have no more than 2 misdemeanors or no more than 1 felony and 1 misdemeanor conviction and have been crime-free for 10 years.
