There are situations where such records can be sealed or expunged. A sealed record is not accessible by anyone other than certain law enforcement personnel. This means, for example, if a potential employer runs a background check, a sealed record will not come up. An expungement involves removing the record completely.
You are applying to seal an ineligible offense, including a violent felony, Class A felony, homicide felony, sex offense, sexual performance by a child offense, or a felonious attempt or conspiracy to commit any of these ineligible offenses.
The Clean Slate Act (CPL 160.57) will automatically seal an individuals New York State criminal records. The law takes effect on November 16, 2024.
For information regarding a specific legal issue affecting you, please contact an attorney in your area. For better or worse, the fact is that in the state of New York, you cannot expunge your criminal record. A record that is expunged is permanently erased.
Once a case is sealed in New York, it will no longer show up in background checks conducted by most private companies, which rely on public government records [4].
Sealed Records: After 10 Years (CPL 160.59) If you have no more than two misdemeanor convictions or one felony and one misdemeanor conviction, you may be eligible to have those convictions sealed. You must apply to the court to have your records sealed.
You must file a Notice of Motion and Affidavit in Support of Sealing Pursuant to CPL 160.59 with the court in which you were convicted. Instructions are provided on nycourts.gov. It is important to understand that record sealing for convictions is not automatic or guaranteed.
