Hyphenated last name basics A double surname also allows people to preserve their professional identity under their maiden names while also showing unity with a partner. Taking a second surname alongside your own last name still isnt the norm, but there are signs that it could become more popular.
You will need to pay a filing fee at the time of submitting the forms. (This varies from around $70 to $200. For reference, the fee in St. Marys County is $135.)
It is not illegal to use more than one name---though you will HAVE to choose one to use for all legal documents, and then ALWAYS use that full name for ALL legal and quasi legal documents.
When getting married in Maryland, each spouse can choose to take the other spouses name. They can also choose to use a hyphenated version of the two names or choose any name after they are married, as long as it is done consistently and not for an illegal purpose.
To ask the court for a name change, you need to file a petition. You can use the Petition for Change of Name of an Adult (CC-DR-60) or Petition for Change of Name of a Minor (CC-DR-062). Attach documents with your or the minors current name (birth certificate, drivers license, passport, etc.).
The use of double surnames is legal but not customary. Children traditionally take on their fathers surname (or, more recently, optionally their mothers).
Generally, there are no set rules or etiquette when it comes to deciding exactly how your hyphenated last name will read. You can go the traditional route and list your maiden name first, or you could choose to list your new last name first, followed by your original last name.
If both parents do not consent to the name change, then you may ask the court to decide. You need to show the court that the name change is in the childs best interests, and that the circumstances of your case are extreme.
