Concealed carry is legal in Maryland only for Maryland Wear/Carry Handgun Permit (WCHP) holders. Open carry is prohibited as of October 1, 2023. In order to obtain a WCHP, applicants must be at least 21 years old (or 18 years old for employment purposes only). For each category, additional documents are required.
Open and concealed carry Carrying a handgun, whether openly or concealed, is prohibited except in limited events such as hunting or, unless one has a permit to carry a handgun or is on their own property or their own place of business.
Illegally carrying a firearm in Maryland is a misdemeanor. Penalties vary depending on the number of previous offenses: Penalties for first offenders include up to 3 years in jail and fines ranging from $250 to $2,500. A second conviction carries a prison sentence between 1 and 10 years.
The penalty for wearing, transporting or carrying a handgun without the proper permits is a misdemeanor, as well as a jail sentence ranging from 30 days to three years and a fine ranging from $250.00 to $2,500.00. If the crime is committed on school property, the minimum jail sentence is 90 days.
Please allow 90 days for completion of the application process. For further guidance in regard to submitting a Wear and Carry permit application or request please refer to the Wear and Carry Portal Users Guide.
If the firearm is a wear, carry, or transport, the penalty is up to three years incarceration and up to a $2,500 fine for unlawfully transporting a handgun. That is assuming the person has no other records, history charges, crimes, or any other enhancements.
Permit applicants must submit completed applications through the Maryland State Police Licensing Portal. That Portal allows the applicant to include proof of training or exemption, fingerprints, passport-style photo, and $125 non-refundable fee. Use of the Portal does require one to have an email address.
Misdemeanor Offense: Possessing a firearm without the required license in Maryland is considered a misdemeanor offense. A first offense may result in up to three years in prison and/or a fine of up to $1,000. Repeat offenses carry more severe penalties.
