How long does a trademark last?

Trademarks, unlike patents, can be renewed forever as long as they are being used in commerce. Trademarks are registered with the United States Patent and Trademark Office (USPTO). Federal trademark registration has several benefits: Constructive notice nationwide of the trademark owners claim.

Is there a grace period for trademark renewal?

Is there a trademark renewal grace period? If you miss a trademark registration maintenance deadline, there is good news. You have a 6-month trademark registration grace period. Unlike patents, a federal trademark registration can last indefinitely as long as the owner diligently maintains the registration.

What happens when a trademark is not renewed?

The term of protection for registered trademarks is 10 years, though indefinite protection can be achieved if the mark is renewed every decade. Lateness in filing this renewal can cause many complications for the owner, ranging from increased fees to losing protection of the mark altogether.

How do I update my trademark information?

If your trademark has not published in the Trademark Official Gazette, use the TEAS Voluntary Amendment form. If your trademark has published but hasnt registered, use the TEAS Post-Publication Amendment form. If your trademark has registered, use the TEAS Section 7 Request form.

What happens if you dont renew your trademark?

If you fail to do them long enough, you will lose your rights to use the trademark. To avoid losing those rights, mark the fifth and every 10-year anniversary on your calendar. Make sure you can provide a section 8 declaration and that you have proof of usage of your trademark.

Do you lose a trademark if you dont use it?

Trademark abandonment, in general terms, occurs when a mark owner discontinues use of the mark with no intent to resume use. Nonuse for a period of three years creates a presumption of abandonment. Abandonment also occurs when the mark owner takes action that causes the mark to become generic.

What happens if I let my trademark expire?

Inability to Enforce Rights: An expired trademark typically means the owner loses the ability to enforce their trademark rights against others using a confusingly similar mark. This situation allows other businesses to use the same or similar mark without facing trademark infringement claims.

How often should I renew my trademark?

The mark may be renewed every five (5) years as long as the mark is in continual use.
