The vendor charge for a comprehensive national search varies from country to country, but generally is within the range of $500 to $1200 per country/per mark/per class. Turnaround times for comprehensive national availability searches vary between five to twenty days.
If ownership of the mark has changed you must file an Assignment of Trademark or Service Mark. Registrant must attach a true and correct copy of the original document showing proof of name change, or a copy of the original document filed in another jurisdiction and certified by the filing office of that jurisdiction.
A: Trademark clearance is the process where you submit your desired trademark to the USPTO to determine if anything similar is already in use. If your trademark is too similar or the exact same as something that already exists, you can then make changes to ensure you arent copying another companys assets.
A trademark usually takes between 12 to 18 months to get approved. Understand that the trademarking process is a Federal legal matter that can be complex, technical, and has several stages. Plus, youre working with the Federal government, which is not known for moving quickly.
The clearance process involves researching existing trademarks to determine if there are any conflicting marks, as well as evaluating the marks distinctiveness and its potential to cause confusion with other marks in the same industry.
If your trademark has fallen into dead or abandoned status unintentionally, you may petition the USPTO within 60 days of the Notice of Abandonment. After the 60 days have lapsed, or if you cannot document the abandonment was unintentional, you will need to file a trademark application with the USPTO.
A trademark clearance search is the process of researching to see if there is another in-use trademark that is similar to your own. The search includes all your efforts to confirm your marks availability, such as looking through trademark resources provided by the United States Patent and Trademark Office (USPTO).
If the mark has already been placed on the Principal Register, the party may petition the USPTO for cancellation of the registration. (15 United States Code, Section 1064.) A cancellation petition may be filed: within five years from the date the mark is published in the Official Gazette.
