A: Trademark clearance is the process where you submit your desired trademark to the USPTO to determine if anything similar is already in use. If your trademark is too similar or the exact same as something that already exists, you can then make changes to ensure you arent copying another companys assets.
In the United States, a trademark can last forever, so long as it is used in commerce and renewed on time every ten years. To renew a registered trademark, the owner must file the maintenance documents with the United States Patent Trademark Office (USPTO) and meet certain legal requirements.
For a more in-depth search, you may choose to use a trademark screening service or work with an experienced U.S.-licensed attorney. An attorney can provide a clearance search and interpret the search results as well as advise you on how to apply for federal trademark registration.
If the mark has already been placed on the Principal Register, the party may petition the USPTO for cancellation of the registration. (15 United States Code, Section 1064.) A cancellation petition may be filed: within five years from the date the mark is published in the Official Gazette.
To summarize, neglecting to renew a trademark registration may result in the trademark being abandoned, resulting in the loss of legal protection and the right to claim the registration. It may also harm a companys image and brand, making it harder to defend goods or services against infringement or counterfeiting.
A registered trademark can potentially last indefinitely if it is regularly renewed every 10 years and if the trademark owner continues to meet all other legal requirements and obligations associated with trademark maintenance.
Unlike patents and copyrights, trademarks do not expire after a set period of time. Trademarks will persist so long as the owner continues to use the trademark. Once the United States Patent and Trademark Office (USPTO), grants a registered trademark, the owner must continue to use the trademark in ordinary commerce.
