Beginning November 18, 2024, as part of new Federal regulations, drivers with a prohibited status in FMCSAs Drug and Alcohol Clearinghouse will lose or be denied their State-issued commercial driving privileges.
The first Clearinghouse final rule requires FMCSA-regulated employers, medical review officers (MROs), substance abuse professionals (SAPs), and consortia/third-party administrators (C/TPAs) to report to the Clearinghouse information related to violations of the drug and alcohol regulations in 49 Code of Federal
One major change coming in November 2024 is the revoking or denial of CDLs/CLPs for drivers with prohibited statuses in the FMCSA Clearinghouse. This status results from drivers having drug and/or alcohol violations recorded in the Clearinghouse.
A USDOT number is actually the exact same as a DOT number, it just has the prefix US in front of it to indicate it is an American number.
The Clearinghouse final rule requires the following: Employers must query the Clearinghouse for current and prospective employees drug and alcohol violations before permitting those employees to operate a commercial motor vehicle (CMV) on public roads.
How do I get a Clearinghouse Violation Cleared Up? Select a Substance Abuse Professional. Take the return-to-duty test. Once your Clearinghouse status is not prohibited, you are eligible to resume performing safety- sensitive functions.
The Clearinghouse-II final rule (86 FR 55718) requires that, beginning November 18, 2024, State Driver Licensing Agencies (SDLAs) must remove the commercial driving privileges from the drivers license of an individual subject to the CMV driving prohibition.
Under My Dashboard, go to Violations and access your Violation History. Locate the violation and click View Violation Details. Click Request to Remove Violation FMCSA will review the request and, if approved, remove the violation from the Clearinghouse.
