You are applying to seal an ineligible offense, including a violent felony, Class A felony, homicide felony, sex offense, sexual performance by a child offense, or a felonious attempt or conspiracy to commit any of these ineligible offenses.
Nearly every state has existing laws that allow people to petition to seal or clear their criminal record after a certain amount of time. Unfortunately, the petition process to clear criminal records in most states is complicated and burdensomeand often costly.
Generally, only the police force that created the non-conviction record can decide whether to remove (purge) the information from the local and national databases. This means that you should ask the police force that investigated, arrested or charged you to purge the non-conviction record.
There are situations where such records can be sealed or expunged. A sealed record is not accessible by anyone other than certain law enforcement personnel. This means, for example, if a potential employer runs a background check, a sealed record will not come up. An expungement involves removing the record completely.
For information regarding a specific legal issue affecting you, please contact an attorney in your area. For better or worse, the fact is that in the state of New York, you cannot expunge your criminal record. A record that is expunged is permanently erased.
The Clean Slate Act (CPL 160.57) will automatically seal an individuals New York State criminal records. The law takes effect on November 16, 2024.
Waiting Period: (ii) 8 years for a (non-A) felony. (ii) if there was no sentence of incarceration, from the sentencing date. Note: If the individual is convicted again during the waiting period, the waiting period is reset to the most recent conviction.
