An Expungement is the removal of court and police records from public inspection. This does not include Motor Vehicle Administration records, which may have minor traffic violations, such as a speeding ticket. This process should take no more than 90 days unless there is an objection or an appeal.
The entire process can take up to eight months. How long does it take for the Department of Attorney General to review my application to expunge my criminal record?
Generally speaking, you can expunge Class B felonies after 7 years and Class C felonies after 5 years. You can almost never expunge Class A felonies and serious sex offenses. As for misdemeanors, you can expunge Class A misdemeanors after 3 years and low-level Class B or C misdemeanors after only 1 year.
How much does a misdemeanor or felony expungement cost? The total fee for expunging a conviction is is $800. We are open and transparent about our cost structure and how it breaks down: $33 Oregon State Police Background Check Fee.
Under Oregon law, you cannot expunge any conviction for a state or municipal traffic offense. This includes Driving Under the Influence of Alcohol or Drugs and the following offenses: Reckless driving. Vehicular Assault.
For a Class B Felony: seven years from the date of your most recent conviction or release from prison. For a Class C Felony: five years from the date of your most recent conviction or release from prison. For a Class A Misdemeanor: three years from the date of your most recent conviction or release from prison.
In January 2022, Oregons expungement law, ORS 137.225, underwent docHub changes with the enactment of Senate Bill 397. This legislation, passed with strong bipartisan support, aimed to enhance accessibility by eliminating filing fees and reducing eligibility waiting times.
Pennsylvania has expungement laws that help people who received a summary offense, Accelerated Rehabilitative Disposition (ARD) or had an arrest that did not lead to a conviction. Expungement usually takes about 4 to 6 months. Attorneys typically charge between $700 to to $1000 to expunge your record.
