What is the difference between SM and TM? A service mark serves the same essential purpose as a trademark distinguishing the offerings of one proprietor or enterprise from those of another while applying only to services, as opposed to products or goods.
The TM symbol indicates that you are claiming rights to trademark next to it. The trademark symbol is the most common and recognizable trademark symbol. The trademark symbol SM stands for service mark and is used next to service marks, which promote a service.
In the United States, it is proper to use the registration symbol only to give notice that a trademark has been federally registered in the United States Patent and Trademark Office. The proper form of registration notice is the letter R in a circle placed in immediate conjunction with the registered mark.
To insert the registered trademark symbol, press Ctrl+Alt+R.
Once you register your trademark with us, use an with the trademark. You may use the registration symbol anywhere around the trademark, although most trademark owners use the symbol in a superscript or subscript manner to the right of the trademark.
You do not have to have registered a trademark to use it and many companies will opt to use the TM symbol for new goods or services in advance of and during the application process. The R symbol indicates that this word, phrase, or logo is a registered trademark for the product or service.
2. What does SM mean? SM stands for service mark (often seen in superscript like this: SM). It functions similarly to the TM symbol, in that it is used to provide notice that rights in the mark are claimed, but it is used in connection only with a service, such as banking or legal services, rather than tangible goods.
TM or SM are for unregistered marks only. Use TM for marks that represent goods and SM for marks that represent services. If your mark covers both goods and services, use TM. The federal registration symbol, , is only for marks registered with the USPTO.
