The Voluntary Cleanup Program (VCP) allows private parties and government entities to voluntarily investigate and, if warranted, clean up potentially contaminated properties. Remediation activities are negotiated and overseen by the Oklahoma Department of Environmental Quality and carried out by the applicant.
The release must: 1) be into the environment; 2) be equal to or exceed the RQ for a particular substance; and 3) occur within a 24-hour period. Under CERCLA, the term environment is defined broadly to include any surface water, groundwater, drinking water supply, land surface, subsurface strata, and ambient air.
The State Cleanup Program manages sites that are contaminated with hazardous substances or petroleum but are not included on the National Priorities List of the federal Superfund program, after which it is modeled.
Historically, under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA, commonly known as Superfund), the owner or operator of a contaminated property could be held responsible for the propertys cleanup, based solely on their current ownership of the property.
Congress enacted the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA; P.L. 96-510) in response to a growing desire for the federal government to ensure the cleanup of the nations most contaminated sites to protect the public from potential harm.
The Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), also known as Superfund, authorizes the President to respond to releases or threatened releases of hazardous substances into the environment.
Cleanups remove toxic chemicals from the environment, or contain them so they cant harm people or the environment. Successful cleanup can also allow for redevelopment of abandoned or neglected properties, called brownfields. Some cleanups also lead to environmental restoration.
Superfund sites and some other large or highly contaminated sites are managed by the Environmental Protection Agency (EPA) under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), known as the Superfund. We frequently partner with the EPA to help with these sites.
