When writing a debt settlement letter, its important to be explicit and detailed. Treat the letter as a contract between you and your creditor. Include your personal information and account number for easy identification. Youll need to outline the amount you can pay and what you expect in return.
The general rule in California is that a spouse ceases to be responsible for any debts incurred by the other spouse once they have separated. However, this rule has an exception, and the exception depends upon when the debt was incurred and what the debt was for.
Start by offering cents on every dollar you owe, say around 20 to 25 cents, then 50 cents on every dollar, then 75. The debt collector may still demand to collect the full amount that you owe, but in some cases they may also be willing to take a slightly lower amount that you propose. A payment plan.
Critical details include: Your name and address. The original holder of your debt and the account number. The current value of your debt. The name of the debt collection agency and their identifying information. The amount you want to settle the debt for. A request to report the account paid to all credit reporting bureaus.
California is a community property state, which means that any assets acquired and any debts incurred by either spouse during the marriage belong equally to both spouses. During your California divorce, you and your spouse will have to agree on how to divide both your assets and your debts.
Copies of your payments may include cancelled checks or credit card statements. You may also include copies of any correspondence about your settling the debt. But only send copies. Keep the originals.
What to Include? A summary of the original incident with any factual disputes highlighted. Evidence to support the version of events provided in the Settlement Demand Letter. An outline of any relevant legal standards that apply to the matter. A settlement offer and terms/timeline for acceptance.
