Beneficiaries are only liable for debts of a Trust to the extent the beneficiary received assets from the Trust. If the beneficiary received $10,000 from the Trust, and the Trust owes $1,000 in debt, then the beneficiary may have to pay back $1,000 to cover the debt.
How a trust can be dissolved will depend on the trust in question. Some trusts will be terminated by the occurrence of a particular event (for example, on the death of a beneficiary or when they come of age) whereas others will be terminated by the actions of the trustees or beneficiaries.
Suze Orman, the popular financial guru, goes so far as to say that everyone needs a revocable living trust. But what everyone really needs is some good advice. Living trusts can be useful in limited circumstances, but most of us should sit down with an independent planner to decide whether a living trust is suitable.
When a person dies, creditors can hold their estate and/or trust responsible for paying their outstanding debts. Similarly, creditors may be able to collect payment for the outstanding debts of beneficiaries from the distributions they receive from the trustee or executor/administrator.
For instance, if a revocable trust has two grantors, it may still remain revocable until all these people have passed away. However, the deceased persons outstanding debts from the revocable trust do not go away, and creditors will still be entitled to the assets listed in the document.
A living trust can help you manage and pass on a variety of assets. However, there are a few asset types that generally shouldnt go in a living trust, including retirement accounts, health savings accounts, life insurance policies, UTMA or UGMA accounts and vehicles.
Revocable living trusts have a few key benefits, like avoiding probate, privacy protection and protection in the case of incapacitation. However, revocable living trusts can be expensive, dont have direct tax benefits, and dont protect against creditors.
This is called your fiduciary duty. If you dont, you can be taken to court and the penalties can be severe. However, if the trust cant pay its debts or if you dont take reasonable care in making a decision that loses money for the trust, you can be liable as a trustee.
