What is the Justice40 Initiative? The Justice40 initiative, created by Executive Order 14008, establishes a goal that 40% of the overall benefits of certain federal investments flow to disadvantaged communities (DACs). DOEs current Justice40 guidance provides a broad definition of DACs (see pages 8-10).
The Bipartisan Infrastructure Law authorizes substantial carbon management funding to other DOE offices. As a part of the whole-of- government approach to achieving net-zero emissions by 2050, FECM will support these research and development efforts in parallel. A summary of the additional funding is included below.
What is the Justice40 Initiative? For the first time in our nations history, the Federal Government has made it a goal that 40 percent of the overall benefits of certain Federal investments flow to disadvantaged communities that are marginalized, underserved, and overburdened by pollution.
Funding. The IIJA is estimated to bring $16.7 billion in transportation formula funds to Florida among FDOT, transit agencies, airports, and other partners. FDOT is estimated to receive $13.5 billion under the IIJA in formula funds. This is $3.5 billion and 35 percent more than provided by the FAST Act.
The Infrastructure Investment Jobs Act (also known as the Bipartisan Infrastructure Law) was signed by President Biden in November of 2021, and will include funding opportunities from the U.S. Department of Energy (DOE) for grid resilience, energy efficiency and conservation, building energy codes, transportation

Here at the U.S. Department of Transportation (USDOT), Justice40 (J40) is an opportunity to address gaps in transportation infrastructure and public services by working toward the goal that at least 40% of the benefits from many of our grants, programs, and initiatives flow to disadvantaged communities.
A Community Benefits Agreement is a contract between a developer and community-based organizations representing residents interests. The agreement spells out the benefits the community will receive in return for supporting the developers project in their neighborhood.
The Justice40 initiative aims to deliver 40 percent of the overall benefits of climate, clean energy, training and workforce development, and other federal investments to disadvantaged communities.
A community qualifies as disadvantaged if the census tract is above the threshold for one or more environmental or climate indicators and the tract is above the threshold for the socioeconomic indicators.
