Checking with the local Registry of Deeds (RD) is the best technique to verify the legitimacy of a title. In the Philippines, each city or province has its own RD, which holds the original titles to all registered lands under its jurisdiction.
2 Ways to Register Unregistered Lands This involves filing a petition in court for original registration of title for a property with no existing title. The claimant must be able to present proof of land possession, along with all other requirements by the court.
This document is issued by the Philippine Registry of Deeds and serves as proof of ownership for a piece of land or real estate. A clean TCT means that there are no liens or encumbrances on the property, which can often be a lengthy and complicated process to resolve.
Clouds on the title are resolved by initiating a quitclaim deed, which releases a persons interest in a property without stating the nature of the persons interests. Any property that has liens or is under foreclosure is unattractive to potential buyers because they create a cloud on the title.
How Can One Acquire a Land Title? The easiest way is through the sale and by executing a document called a Deed of Sale, which shows the legal transfer of title from the name of the seller to the buyer.
Go to the registry of deeds. Every city or province in the Philippines has its own RD, which houses the original titles to all registered lands within its borders. Owners of registered lands, on the other hand, receive an Owners Duplicate Certificate that matches the original title on file with the RD.
To apply to register your land the following documents must be submitted: An Application form prescribed by the Registration of Titles Act and signed by the applicant. A Statutory Declaration by the applicant to prove possession (a statutory declaration is a written statement confirmed by oath).
Many title issues can be resolved by filing one of three common documents: A quit claim deed removes an heir and clears up title among co-owners or spouses. A release of lien/judgment removes a paid mortgage or spousal or child support lien. A deed of reconveyance records payment of a mortgage under a deed of trust.
Check the Serial Number The serial number of Judicial Forms for the original copy should be printed in red while the duplicate copy should be in black. The serial number of the title should follow the serial numbers of the other titles from the particular Registries of Deeds from which your title came from.
