Towards the end of the contract it is important to incorporate a Limitation of Liability Clause which clarifies that the photographer will not be held liable in the event of media loss, theft, or unusable content.
So your cancellation policy may look like this: Standard cancellation fee: 50% of Creative Fee + 100% of expenses. Within 7 days: 75% of Creative Fee + 100% of expenses. Within 48 hours: 100% of Creative Fee + 100% of expenses.
Indemnification: This is a fancy word that means a simple thing: the parties wont hold each other legally liable for anything outside of the contract (and each party handles their own liability). So if the clients kid breaks a vase at a venue youre shooting at, its 100% their responsibility to pay, not yours.
Because a photography contract starts in writing, it should also end in writing. Proper contract cancellation should be well-documented. Both parties should specify the reason for the cancellation and when it took place.
8 Components of a Photography Contract Service Description. Delivery Dates for Final Assets. Payment Terms + Late Fee Policy. Copyright Information + Licensing Agreement. Cost of Additional Deliverables + Licensing. Rescheduling + Date Changes. Responsibility of Expenses. All Parties Contact Information.
Here is a list of important items to include in a freelance photographer contract: Description of work. You should have a clear description of the work you will perform and your deliverables. Event date. Number of photos. Pay rate. Time of payment. Spot for a signature.
By including a liability limitation section in your contract, you protect yourself from unexpected occurrences such as natural disasters, or personal illness. Its also a good idea to state in this section if you will provide a replacement photographer in such cases, and/or provide a full or partial refund.
