What is the Mortgage Deed? This can sometimes be known as the legal charge form. Your mortgage deed is usually a 1 or 2 page document that, once signed, provides confirmation that youre happy to proceed based on the terms of your mortgage offer. Upon completion, the signed mortgage deed is a legally binding document.
The Mortgage Deed is the document that states that you and the lender have agreed to use the property as a security to protect the mortgage. The Deed contains information on the conditions of the mortgage, repayment schedule, length of the mortgage, mortgage rates, type of mortgage and security for the mortgage.
Characterised by a reference number, and unique to the lender, a Mortgage Deed is the formal Deed which, when purchasing a property with the assistance of a mortgage, or indeed re-mortgaging a property, you, the borrower, must sign to confirm agreement to the terms set out within the Mortgage Offer.
Following completion, your conveyancer will pay stamp duty land tax on your behalf. They will also let the Land Registry know that you are the new owner of the property and that the mortgage lender has an interest in your property.
Your witness must be over the age of 18 and they must not be a relative/family member. They must also not be a party to the transaction (this will ensure that they are considered to be an Independent Adult Witness).
If your name is on the mortgage, but not the deed, this means that you are not an owner of the home. Rather, you are simply a co-signer on the mortgage. Because your name is on the mortgage, you are obligated to pay the payments on the loan just as the individual who owns the home.
Ultimately, although it is possible for anyone who is not a party to the deed to act as a witness, it is strongly advised that they are independent and over the age of 18.
To put simply, the deed is the legal document that proves who holds title to a property, while a mortgage is an agreement between a financial lender and borrower to repay the amount borrowed to purchase a home.
It is also advisable that the witness be no younger than 18 or, at least, of sufficient maturity for their evidence to be relied on should it later prove necessary to verify the circumstances under which the execution took place.
If there is more than one Borrower, each Borrower that executes the Mortgage Deed will need their signature to be separately witnessed.
