You can search through copyright files by visiting the Copyright Office at .copyright.gov/records (see Figure 2, below). All copyright information is located in the Public Catalog (click Search Public Catalog) which contains information about works registered since January 1978.
The key difference between a license and an assignment is that an assignment transfers rights away from the original copyright or patent holder. Whereas the licensor retains ownership of the intellectual property rights, the assignor gives up the rights entirely.
Copyright is generally owned by the creator of the work in the first instance. However, copyright ownership depends on a number of different things such as the type of work created or how the work was created, for example by an employee as part of their job. Determining who owns copyright in a work can be complex.
A copyright license is different from a copyright assignment as, in licensing the licensee gets the certain rights subject to the conditions specified in the license agreement but the ownership of those rights is not vested to him, whereas in case of assignment, the assignee becomes the owner of the interests assigned
As a general rule, the author/creator is the first owner of copyright in a work. Where permission to use copyrighted material is needed, it is only the author/creator who can permit usage of his works. The author/creator of a work is furthermore, the only party that can sell, license or give away copyright.
An assignment and assumption agreement is used after a contract is signed, in order to transfer one of the contracting partys rights and obligations to a third party who was not originally a party to the contract.
Does the work have to be published prior to assigning its copyright? No, essentially for the same reasons, copyrights may be transferred whether or not the underlying work has been published. The Copyright Office will record a document evidencing a transfer of an unpublished work.
Signed by both parties, as consideration is a requirement. The assignment need to be notarised and legalised for it to be recorded. The copyrights and the assignment must be recorded for the assignment to take effect against third parties.
