An amendment is typically used to change something thats part of an original contract.
A substituted contract is typically one that contains a new term that is inconsistent with a term in the original contract, and where the parties intend for the new, substituted contract to replace all provisions of the original contract.
It is not illegal to alter a contract once it has been signed. However, it must be materially changed, meaning that if an important part of the contract is altered by the change, it must be made by mutual consent of both parties.
To novate is to replace an old obligation with a new one. In contract law, a novation replaces one of the parties in a two-party agreement with a third party, with the agreement of all three parties. In a novate, the original contract is void.
You need a contract amendment whenever you or the other party wants to change the terms of the agreement. Once youve discussed the change with the other party, one of you will draft the changes, and both will sign them.
Again, both parties should sign or initial and date the amendment to show that both sides agreed to the change. Creating this separate section is usually the easiest way to amend your contract clearly, and it can avoid misinterpretations that are sometimes associated with the other two methods.
