Leases are contracts and like all contracts, cannot be changed without the other side agreeing. The only change a landlord can make to a tenancy agreement without the tenants consent is an increase the rent. A landlord must, however, follow the rules set out in the Residential Tenancies Act for rent increases.
A month-to-month tenancy, also called a periodic tenancy, does not have an end date. The tenancy renews each month unless the tenant or landlord ends it. Month-to-month tenancies allow tenants to stay in a rental unit for as long as they need as long as they pay rent and follow the tenancy rules.
Yes; a landlord can terminate a month-to-month lease in Ontario as long as the reason for lease termination is legal, appropriate, and processed the right way.
To figure out when to give notice, count the number of days starting on the day after your landlord would get the notice and ending on the termination date. The Landlord and Tenant Board can help you determine these dates. Go to Tribunals Ontario to for more information.
Proper notice is required in written form, to the end of the term or lease, giving a notice period of at least 60 days. Text communication would not be deemed legal notice.
You are not required to pay for anything more unless the landlord obtains special permission from the LTB (tenancy board). If you sent a lease termination in error, then write to the landlord immediately to withdraw it. You can continue to live in your unit unless the LTB orders you to leave.
Fixed-term: If you have a fixed-term tenancy, like a one year lease, then you must give notice at least 60 days before the end of the lease. The termination date cannot be before the last day of the fixed term. If you dont give notice, the tenancy continues.
If you do not give a notice to terminate your tenancy, your tenancy automatically renews and you can stay in the unit as a month-to-month tenant.
