hello landlords its ernie garcia your landlord attorney and today were gonna have the talk youre still getting it wrong lets get started so its been happening for a dozen years now ive been representing landlords who simply dont get this right its your notice to vacate youre youre writing it correctly everything on it is perfect but your method of delivery stinks and you get to court and you get turned around because at some point someones going to challenge your method of delivery because tenants are getting smarter or theyre showing up with counsel and the first thing theyre going to ask is so how did you deliver your notice to vacate and when you say well i did it this way and its wrong you got to start over your judge will deny your eviction petition and make you begin from scratch im going to give you some helpful advice to help prevent that from ever happening again landlords i want you to look through all of the examples that im about to show you each one is goin

If an order for eviction has been granted, a tenant has 30 days to file an appeal to the Ontario Superior Court of Justice, Divisional Court, by serving and filing a Notice of Appeal and paying the requisite fee.
You can challenge your landlords eviction claim when you get the court papers. You should reply to the court within 14 days of getting the court papers. Even if you dont reply, you should still go to your court hearing.
The tenant is required to fill out a form called a Motion to Set Aside an Ex Parte Order and submit it to the Landlord and Tenant Board office within 10 days from when the Order was issued. This 10-day period includes weekends and holidays. Once this form is filed, the Board will schedule a new hearing date.
You can file Form T2 and Form T6 applications online using e-File. These forms are for a tenant to use when giving notice to a tenant to end the tenancy.
You can ask the Landlord and Tenant Board (the Board) to use subsection 83(1) of the Residential Tenancies Act to deny or delay your eviction based on compassionate grounds. The Board must consider relief from eviction in every landlord application seeking to evict a tenant.
An N5 form is a legal notice of the landlords intention to end a tenancy because the landlord believes the tenants behaviour is interfering with other peoples ability to enjoy living there.
Termination date must be the last day of the rental period or lease term. You can file this application online through the Tribunals Ontario Portal. Application must be filed no later than 30 days after the termination date shown in the notice.
The deadline to appeal an LTB order to the Divisional Court is 30 days after you receive the order. If the 30-day deadline has passed, you can bring a motion to the Divisional Court requesting an extension of time. You do not have to file a Request to Review an Order with the LTB before you appeal to Divisional Court.
