landlords one thing youre getting wrong with your security deposit is how you deduct funds from the deposit after youve made repairs do you have actual receipts to prove in a court of law if youre challenged by your tenant if you dont you may have a hard time justifying any of the deductions youve made from your tenant security deposit its not enough that you gave them notice and its not enough that you itemize that list for them within the time required by Texas law if you cant actually prove that you paid certain amounts for certain repairs you may not be able to recover from that deposit and you may end up with a judgment where you owe your tenant money for a wrongful withholding of their deposit funds have the proof be ready for trial make sure you can justify every penny you deduct from your tenants security deposit
