Estate planning attorneys often recommend that you avoid codicils and simply provide any desired alterations by writing a new will. While this may sound time-consuming, the process for enacting and verifying a codicil is the exact same as enacting and verifying a new will.
Amending a Will is easy. Just formally write down any specific updates, whether that means changing something existing or taking something out, sign it, and have witnesses also sign.
So, whether a codicil will completely override an entire will or codicil depends on the terms included in the codicil. For example, if the codicil revokes the will entirely, then the terms included in the codicil will be the only provisions followed in probate.
A codicil is a fancy name for a document that updates your last will and testament. Depending on the situation, it may be better for you to create a codicil to your existing will as opposed to creating a completely new will, while at other times the reverse is true.
California wills can be updated, modified, or amended at any time during the life of the testator. A will can be revised by drafting and executing a codicil. A will can also be updated by revoking it and executing a new will. A codicil is an amendment to the will.
There is, however, a drawback: A codicil is unlikely to seamlessly fit with the original will. Is it a pure addition, or does it also negate something in the original document? If its supposed to replace part of the first will, which part?
But codicils have pitfalls, and many estate planning lawyers prefer to prepare a new will. There are many reasons a new will may be a better choice: A new will is clearer. The first codicil to your will may be relatively easy to understand, but multiple codicils can become confusing and may contradict each other.
