Its great to be back. - And today, Shawna and I are gonna tackle a topic that can actually feel very massive, but I think a lot of people have preconceived notions about it and are very unclear about it. And it has a little bit of a stigma, but here at Atlanta Divorce Law Group, we like to go after the stigmas, tackle them and bring some light to them. And the topic is prenups and postnups. Shawna, before we start assuming everybody knows what those things are. Can you just break down, what is a prenup? What is a postnup? - Absolutely, a prenuptial agreement is a negotiable instrument, which means its a contract between you and your future spouse about whats gonna happen in the event that the marriage does not work out. Both a prenuptial agreement and a postnuptial agreement can be challenged in court. Some state laws specify that the agreement must be made freely by both parties. Others specify that neither party can have hidden assets that are excluded from the agreement. Such issues could be the basis of a challenge.
Yes. Like a prenup, a postnup can also be edited and amended after it has been created. Situations change, and life happens.
It is possible to make changes to these agreements, or even revoke it if desired.
Any indication of coercion, fraud, deception, threat, or physical force makes the agreement null and void. It must be fair. A postnuptial agreement cannot be unfair or unconscionable, meaning blatantly one-sided or otherwise unjust toward one spouse when considering the facts and circumstances of the relationship.
Other elements that will be seen as invalid by the court include: The document attempts to settle items that cannot validly be agreed to in a postnuptial agreement (such as a child support agreement) The document contains false or incomplete information. The postnuptial agreement is grossly unfair to one of the spouses.
A postnuptial agreement cannot provide enforceable terms for child support or custody. However, it can include provisions for alimony since that is considered separately from a spouses duties as a parent.
Any trace of concealment or deception can lead to the agreement being invalidated. Another crucial aspect in California is the fairness of the agreement. If a court determines that the agreement is docHubly biased or unfair to one party, it will likely be dismissed.
