Several elements must be present for a lease to be valid in Florida. These include: Offer and acceptance: The landlord and the tenant must voluntarily agree to the lease terms. Legal capacity: Both parties must have the legal capacity to enter into a contract, meaning they must be of legal age and mentally competent.
A Florida landlord can terminate without cause a month-to-month tenancy by giving the tenant a written notice at least 30 days before the end of the monthly period. The notice must inform the tenant that the tenancy will end in 30 days and that the tenant must move out of the rental unit by that time.
In most instances, breaking lease agreements usually requires the tenants to pay about 2 to 3 months rent or forfeit their security deposit. You can negotiate the termination fees with the landlord with the intention to have him/her reduce the fees and return your deposit.
Florida law dictates that your landlord cannot alter your lease before it expires without a valid reason.
Landlords in Florida cannot include provisions that waive the tenants basic rights, such as the right to a court hearing, or provisions that allow the landlord to retain the security deposit without justification. Illegal clauses that impose excessive late fees beyond what is considered reasonable are also forbidden.
Always check with your local county office for any laws that may apply in your local area. Florida landlords can ask for a fee instead of a security deposit. Legislation: House Bill 133. Notice periods have changed to end a monthly tenancy. Legislation: HB1417. Rent control cant be introduced but limits may apply in 2024.
Tenant rights include having the peaceful and private possession of the dwelling while allowing for entry from the landlord in the above-described circumstances. Depending on the type of dwelling, tenants have the right to certain conditions as detailed in landlord responsibilities.
