What three decisions cannot be made by a legal power of attorney? A power of attorney cannot change or invalidate a will, act outside of the principals best interest, or violate the terms of nominating documents, and cannot make decisions on behalf of the principal after their death.
If you need to override the principals decision, you must show the court a good reason for it, including psychiatric issues or dementia. This can often involve a battle of the experts such as mental health professionals and doctors are doing whether or not the principal is incompetent.
Consulting the principal should always be the first path. Explain any concerns about their chosen agent. If theyre of sound mind, the principal can override power of attorney verbally and select a new agent. Its also a good idea to have them complete a revocation of POA form so the decision is officially documented.
A power of attorney (POA) is a legal contract that gives a person (agent) the ability to act on behalf of someone (principal) and make decisions for them. Short answer: The principal who is still of sound mind can always override a power of attorney.
As the principal, you have the right to revoke a power of attorney as long as youre physically and mentally able.
It is self-dealing for an attorney-in-fact to name himself as POD beneficiary. In most States, this would be a violation of the fiduciary responsibilities of the POA. You really need to talk to your own attorney and not the one that drafted the POA, as that in itself would be another conflict of interest.
Answer: A basic rule of powers of attorney is that the attorney-in-fact cannot add, change or remove POD beneficiary designations without specific stated authority within the power of attorney.
