Your landlord can only ask you to leave during the fixed term if they have certain reasons ('grounds'). For example, if: you're behind with your rent payments ('in arrears') you've used the property for illegal purposes, like selling drugs.
30-days' Notice: If you want to evict a month-to-month renter with no lease in place, you must give 30-days notice before you ask for eviction.
Your landlord must send you a "14-Day Notice to Quit" if terminating your tenancy for non-payment of rent (M.G.L. c. 186, § 12). If it is being terminated for any other reason, you must be given written notice 30 days, or one full rental period in advance, whichever is longer.
Under California state law, a landlord can terminate a month-to-month tenancy by serving a 30-day written notice if the tenancy has lasted less than one year, or a 60-day notice if the tenancy has lasted more than one year.
This generally occurs when the tenant has broken one of the terms of the lease. A landlord can also terminate a tenancy by lease for non-payment of rent. Absent one of these reasons, a landlord cannot arbitrarily terminate a lease agreement (unless the agreement provides for this).
Unlike a lease agreement, either the landlord or the tenant can terminate a rental agreement at any time upon proper notice. Most landlords use printed forms for their leases and rental agreement.
Ending a month-to-month agreement – Landlord A 30-day notice is required if the tenant has lived there less than a year. A 60-day notice is required if the tenant has lived there a year or longer. A 90-day notice is required if the tenant is under Section 8.
New York State laws make it illegal for landlords to engage in any action that is intended to force tenants to leave their homes or otherwise give up their rights under law.
A tenancy-at-will can be either oral or written. The landlord or tenant can end a month-to-month tenancy-at-will by giving a written 30 days (minimum) notice to quit that must expire at the end of a rental period. Pay special attention if the notice to quit is given in February, which has less than 30 days.
Either the landlord or the tenant can decide to end the tenancy by giving the other party notice either 30 days or one month before the due date of the next rent payment, whichever is longer. In this type of agreement, the rent can change within the same 30 days or one month before the tenancy ends.
