The surviving spouse still has the same power they had before their spouses death to amend the trust or revoke the trust. A revocable trust becomes irrevocable when the second spouse dies. The successor trustee will take over management of the trust, but will not have the power to change it.
Fill out the form with the name of your trust. If this is the first change youve made to the trust, state that. If you have made other changes to the trust, you will need to list them by date. Indicate if this amendment overrides those previous changes or if you want them to remain in effect.
Like a will, a living trust can be altered whenever you wish. One of the most attractive features of a revocable living trust is its flexibility: You can change its terms, or end it altogether, at any time.
In other situations, a joint revocable trust is prepared so that after the first death, the entire remaining trust estate, including that portion belonging to the deceased spouse, remains revocable by the surviving spouse (sometimes referred to as the outright approach).
Moving a trust means changing its situs from one state to another. Generally, this isnt a problem for a revocable trust. In fact, its possible to change situs for a revocable trust by simply modifying it. Or, if thats not an option, you can revoke the trust and establish a new one in the desired jurisdiction.
Here is what you need to do within a few days of the death of your spouse: Tell your family members and friends your spouse has died. Contact the Social Security Administration (SSA). If your spouse was an active or retired military member, contact the Department of Veterans Affairs (VA).
See our 10 tips for things you shouldnt do after theyve died: 1 DO NOT tell their bank. 2 DO NOT wait to call Social Security. 3 DO NOT wait to call their Pension. 4 DO NOT tell the utility companies. 5 DO NOT give away or promise any items to loved ones. 6 DO NOT sell any of their personal assets.
