Landlords are prohibited from doing the following acts if done to harass the tenant: Taking away services provided in the lease (housing services). Refusing to do required repairs. Entering the apartment without proper notice.
What is a month-to-month lease? A month-to-month lease is an agreement between a landlord and a tenant that establishes occupancy without a specific end date. Each month, the lease automatically renews until either the landlord or tenant gives proper notice to end the contract.
The reason for this is that as the lease is a contract between two parties, the leaseholder and the landlord, both parties must agree to change (referred to also as variation) of the terms of the lease. The landlord or the leaseholder cannot change the lease terms without the other party agreeing to the change.
California law allows landlord to change the terms of a month to month tenancy with proper notice. However, changing is not always as simple as just sending a notice.
Tenants may withhold rent, move out without notice, sue the landlord, call state or local health inspectors, or exercise the right to repair and deduct if a landlord fails to take care of important repairs, such as a broken heater. While California law specifies that month to month rentals must receive a 30 or 60 Day Notice to Vacate based upon how long the tenant has been renting, a fixed-term lease may only be terminated by the landlord for cause by first serving a 3 Day Notice to correct the condition or the lease is being terminated.
Tenants cannot be evicted for making a complaint against the landlord or for anything discriminatory. Under the Fair Housing Act, its illegal for landlords to discriminate against a prospective tenant based on sex, race, color, national origin, religion, familial status, or disability.
Tenants cannot unreasonably deny a landlord entry into their apartment. If a tenant unreasonably refuses to give the landlord access to the unit, the landlord could use continual refusal as a basis to attempt to evict the tenant.
Unlike a lease agreement, either the landlord or the tenant can terminate a rental agreement at any time upon proper notice. Most landlords use printed forms for their leases and rental agreement.
